As you know, Flash support on all major browsers will end on December 31 2020.
This is a decision that has been taken by Google, Microsoft, Mozilla, Opera and Adobe and is sadly out of our control.
To keep Royal Games running we have had to convert our games to the new web standard for interactive content, HTML5.
We laid out earlier which games will be converted and will still be playable in HTML5 at the start of 2021.
Flash games will start to be deactivated from this week onward. Open tournaments will still be allowed to finish.
Because there are many Flash elements (VIP Spinner, My Castle, Avatar, Jewel Meter etc) on the site, we have had to prioritise those that will allow most of the functions you use on the site to keep working without too much issue.
Things are going to look weird - at least at the start…
You will notice after we deactivate many of the Flash Games, some parts of the site will look odd and there will be things that need fixing, especially at the beginning of this transition. We appreciate your patience while we take audit and make plans to rectify these issues.
VIP Spinner Changes
We will have to make changes to the VIP Spinner games, where we add some games and remove others.
Tuesday and Friday Freeroll Changes
From January 1st 2020 Freerolls will now be on Friday’s only. The Daily Freeroll Calendar will remain the same. Tuesday Freerolls will be replaced with Royal Cups or another TBC promotion.
Unfinished Cups
The deactivation of some games may result in Cups not finishing. We are working on a solution to end these cups and refund you all for cups that can’t be finished. We are aiming to complete this in the first quarter of 2021.
Royal Games Lives!
In the end, Royal Games will continue into 2021. You will still be able to play games and enter tournaments. We will continue making improvements throughout the year. We truly appreciate your patience and your loyalty.
If you can, please try and refrain from creating customer service tickets about unfinished cups in December as we are aware and are working on a solution.
If you do have feedback or comments, please leave them below rather than sending a ticket to our customer service staff as they are very busy at the moment trying to answer other questions.
1 Introduction. These Terms set out your rights and obligations and those of Midasplayer (Skills) Limited, registered in England and Wales with registration number 8589489 and its registered office at The Ampersand Building, 178 Wardour Street, London UK W1F 8FY
King is also referred to in these Terms as "we", "us" and “our”, in relation to the online skill games (the “Games”) and related services (together "the Games Service”) provided by us through this website (www.royalgames.com) or mobile application. By accessing this website, mobile application and/or registering for the Games as a “Member”, you agree to these Terms. If you are not a Member you similarly confirm that you are bound by these Terms each time you access the Games. You may access these Terms at any time by using the link to these Terms on the bottom of the start page of the Games or where indicated in the mobile application. We may revise these Terms at any time in accordance with Clause 25 below and your continued use of the Games or your money account (if applicable) with King (an “Account”) shall be deemed irrevocable acceptance of those revisions. YOU MAY NOT PLAY THE GAMES FOR MONEY UNLESS YOU ARE AT LEAST 18 YEARS OF AGE.
2 The Games Service provides its Members with the ability to play the Games and to participate in tournaments with other Members. The Games are, in fact, games of pure skill and there is no chance element to them. Thus, when participating in a tournament with other Members it is your speed and skill in playing the Game that is assessed against other Members, and the winner will be the Member who, through skill and judgement, scores the most points in the relevant Game. You should familiarise yourself with each Game, by reading the rules and instructions before you play.
We are not an internet service provider. To play our online Games, you must have internet access and the skills required for web usage. To play our mobile Games you must have a mobile handset that is suitable for playing the Games. You will be responsible for the data charges that your mobile operator will charge you for playing our mobile Games. You should ask your mobile operator if you are unsure what these charges will be before you play.
The Games and tournaments hosted by us will function best if your computer (or mobile phone, if applicable) meets the technical requirements described in the technical section of our FAQ’s. It is your sole responsibility to confirm the technical compatibility between your computer system and the Games.
3 Registration and Membership. You do not have to be over 18 years old to register with us to play free Games. However, to become a Member that can play Games for money, you must be at least 18 years old, register for the Games and establish an Account with us. By registering and establishing an Account with us you expressly confirm that when playing any of our Skill Games for money that:
(a) you are at least 18 years of age;
(b) you are able to enter into a legally binding agreement with us;
(c) you will not use the Games while you are located in a country, state or jurisdiction that does not allow you to play the Games (if you are not sure, you should check before you play any of the Games for money);
(d) you are not a licensed bookmaker or a bookmaker’s agent, employee of ours or any associated company of ours and that you do not conduct a business of negotiating or receiving bets;
(e) you are not depositing money that does not belong to you, which has been gained from criminal or other illegal activity or with a credit, debit or charge card that does not belong to you;
(f) you are not bankrupt;
(g) you understand that by using the Games Service you may lose money that you may pay to play a Game and accept that you are fully responsible for any such loss;
(h) you will not use this Website for any purpose that is unlawful or prohibited by these Terms; and
(i) if you are located in Estonia, you are at least 21 years of age.
It is your responsibility to ensure that national, state or other laws to which you are subject to do not adversely affect your right to participate in or play the Games.
If you decide to become a Member, or to enter a tournament, the Game Service or the Game in question (as the case may be) will be made immediately available for your use. As a result you will not have the right to cancel these Terms or to any refund of monies you pay once you have started to play a Game and the applicability and enforceability of these terms and conditions shall not be affected by any “cooling-off” period once you have played a Game.
You undertake to register for the Game Service using accurate and current information about yourself including your age, full name and surname, place of residence and a valid email address. You agree to only register one online Account and / or one mobile Account with us. If you hold an online Account and a mobile Account with us any balance that you hold in one Account will be held separately from the other. You understand and agree that if you provide inaccurate information to us we will close any Account that you may have with us. If you are asked for and provide details of a credit, debit or charge card, PayPal account or short message service (“SMS”), you must ensure that (a) you are fully entitled to use that form of payment, and (b) have available funds sufficient to cover the charges that you make.
You will not allow anyone else to use your login details or give them to anyone else. If you do, you accept full responsibility for the consequences of this and agree to fully indemnify and hold us harmless from any damage or harm that may result.
All deposits that you make with us from time to time shall be kept separate and distinct from the funds of ours and shall be managed and administered by any one of our companies.
If no transaction has been recorded on your Account for twelve months, we will pay the balance in your Account to you. If we are unable to locate you we reserve the right to donate such funds to a registered charity of our choice or as set out in clause 13. Our employees, investors and subsidiary companies are allowed to take part in tournaments for the purpose of testing the user experience, but may not withdraw money or prizes for themselves.
4 Games, Winners and Prizes. The number of players participating in a tournament and their relative skills determine the result of all tournaments.
The Player status and Money section of our FAQs provide further information about how you can participate in our tournaments as a practice player and a cash player. They form part of these Terms so you should take the time to read and understand them.
The prize amount of all cash prize tournaments will be disclosed at the outset of each tournament, except in cash progressive jackpot tournaments where the cash prize will be dependant upon the number of participants in the tournament. The indicated cash prize will be the total prize fund that will be distributed to the winning participants. A cash progressive jackpot tournament is open to as many players as wish to participate up to a certain time specified by us, and the prize associated with the tournament will increase as the number of participants admitted to the tournament increases.
Cash prizes will be deposited directly into a winning Member's Account and will usually be available within thirty (30) minutes of a tournament's conclusion. Where a cash tournament ends before its scheduled closing, the prize for the tournament will be reduced to reflect the proportion borne by (a) the number of participants in the tournament when it closes, to (b) the maximum number of participants intended for that tournament.
Game rules, scoring, controls and guidelines for all tournaments offered by us can be found at each specific Game section. Any questions or comments regarding this information should be sent to our Customer Support using the dedicated form here.
At the conclusion of each tournament, we will list the Usernames and scores of the winners. The lists will only be available to the participants of the tournaments. We will also regularly update the site's various high scorer tables. For tournaments with substantial prizes the tournament conclusion and posting of winners may be delayed for up to 5 working days by us to allow for verification of result and prevention of abuse.
Any amounts that are mistakenly credited as winnings to your Account remain our property and will automatically be transferred from your Account upon the error being noticed. Any winnings mistakenly credited to your Account yet withdrawn by you will constitute a debt owed by you to us in the amount of such wrongfully attributed winnings.
Any bonuses that we may give you are not transferable and can only be used by you. Any “guest registration” or “fun money” play that we may provide does not contribute towards any bonus offers that we may offer. Any bonus offers that we may provide remain valid for as long as they are posted on our website unless otherwise stated by us.
On registration and at other times when you make a deposit, we may grant your Account with additional bonus funds and/or credits (“Bonus Funds”). Bonus Funds can be used to play our Games but cannot be withdrawn. You will also be unable to withdraw any funds (including any winnings you make from Bonus Funds) from your online Account until you have spent at least four times amount that you received in Bonus Funds playing our Games. You will be unable to withdraw any funds from your mobile Account until you have at least 2,000 credits. We do this to prevent deposits being withdrawn and Games being played using only Bonus Funds which we don’t think would be fair. Any amounts paid by us to you may only be paid into a Paypal account that is registered in your name.
When you request your first withdrawal from your Account, we will ask you for (a) proof of your identity and (b) your email address. If you are unable to provide this to us, to our reasonable satisfaction we may be unable to pay your requested withdrawal to you. We reserve the right to request this information for subsequent withdrawals too.
We reserve the right to refuse to accept any promotional offers that we make to you and to withdraw them at any time. Any promotional offer that we make is subject to change by us at any time. Any additional terms and conditions that apply to a promotional offer will be displayed beneath it. By accepting a promotional offer and/or making use of a promotional offer, you are confirming that you agree to its terms and conditions.
If you provide materially misleading, inaccurate or incomplete information in your Account, we will be entitled to terminate your Account and cause you to forfeit any prizes you may have won as well as exercise any legal remedies we may have as a result of such conduct.
5 Privacy policy and use of 'cookies'. For information collected under these Terms and this section, the data controller is Midasplayer (Skills) Limited. By registering for the Game Service, you agree to the use of your information in accordance with this section and in these Terms.
Playing our games. When you play the Games or use the Games Service, we collect information about you. Such information includes: the type of device you are using, how you play (such as levels attempted and purchases made), information you provide to us when you create an account or attempt to withdraw funds from your account, identifiers such as IP addresses, device identifiers and ad identifiers, the country or region that you are playing in and the content of customer support correspondence. When you make purchases on or through our website(s), we may collect certain payment information from you on behalf of our payment service providers, but this information is temporarily cached in a way that is unreadable by us. We do not collect or retain credit card information. Our payment service providers will provide us with information about your purchases so that we know if a purchase has been successful. We, our suppliers and group companies, may use this information to enable us to: (i) provide our games and other Services to you, to ensure that any purchases you make are verified on our servers and activated in the games, and to provide you with customer support if you need it; (ii) to enable us to optimise our games for you and for the device that you are using, as well as to deliver customised events, offers and promotions; (iii) for the other purposes as set out in these Terms and Conditions; and (iv) to enable us to comply with laws that apply to us, to prevent fraud, to ensure compliance with our Terms and Conditions or where necessary to defend, exercise or establish our legal rights including our rights under these Terms and Conditions.
The browsers of most computers, smartphones and other internet-enabled devices are typically set up to accept ‘cookies’. Cookies are text files that contain small amounts of information that are downloaded to and stored on your computer, or other device, when you visit a website. Cookies allow us to collect data, such as your device’s model, operating system and screen size and other information about how you use our website and are useful because they enable us to improve your experience on our website. We use cookies to store certain types of information each time you use the Game Service or visit our website. Cookies enable our system to recognise your device, and to ensure that your Account is attributed to the user who inputs the correct Username and Password for that Account. We (or a third party acting on our behalf) may also use cookies to display advertising displayed within our Games Service to you. This advertising may be served by us or by a third party on our behalf. These cookies will not contain any personal information.
Given the global nature of the internet you should always remember that any posting you make on the Game Service (including any which contain personal information) is, of course, accessible to internet users around the world.
It is important to us that everyone playing our Games plays fairly and we treat any abuse very seriously. We therefore take a number of measures intended to prevent abuse and ensure the smooth and uninterrupted performance of our Games. You therefore agree that we can monitor your use of our services and collect and store device information to detect any kind of attempt to cheat and that we can also make use of “Active X” controls and other methods to ensure that our Games are played fairly.
By registering to become a Member, you agree that we may display the Username you select, tournament scores and records publically. By accepting any prize, you consent to our use of your Username and tournament records in any media (newsletters, broadcasts, emails, etc.) for promotional purposes. You agree that we may undertake such promotion without making any payment to you.
We reserve the right to collect general demographic and other anonymous information that does not personally identify you. This information is not associated with your personally identifiable information and cannot be linked to you personally.
We may send e-mails to notify you when you win tournaments, alert you to withdrawals and to let you know of special promotions, events and policy changes. Important notices will be sent to your nominated email address as long as your Account is open, but you have the choice to opt-out of receiving any promotional e-mails at any time by following the opt-out link in the email.
You have certain rights in connection with your personal information and how we handle it. You can exercise these rights at any time by contacting us via any of the methods set out at “Contacting Us” in this section 5. Your rights include:
- Right of access. You have a right to know what information we hold about you and in some cases to have the information communicated to you. If you wish to exercise this right please contact us letting us know that you wish to exercise your right of access and what information in particular you would like to receive. We reserve the right to ask for reasonable evidence to verify your identity before we provide you with any information. Please note that we may not be able to provide all the information you ask for, for instance if the information includes personal information about another person. Where we are not able to provide you with information that you have asked for, we will endeavour to tell you why. We will try to respond to any request for a right of access as soon as possible, but we will always do so within 1 month of receipt of your request and verification of your identity;
- Right to correct personal information. We try to keep the information that we hold about you accurate and up to date. Should you realise that any of the information that we hold about you is incorrect, please let us know at privacy@support.king.com and we will correct it as soon as we can;
- Data deletion. In some circumstances you have a right to have some of the personal information that we hold about you deleted. Should you wish to have any information about you deleted, please contact us using the information below. Please note that in order to process your request you must delete our games from your mobile devices and clear our cookies from any device where you have played our games in a web browser. Where we delete personal information about you, we may still retain some or all of that information for other purposes such as maintaining financial records, protecting or enforcing legal rights, maintaining marketing suppression lists or for technical reasons such as maintaining technical security or our database integrity. We may also retain your information in an anonymised form. In some instances, personal information about you that is visible through gameplay such as username, avatar, your high scores and any chat messages may be cached on other players’ devices and we may not be able to remove or update that data from those devices, for example if that device is not connected to a wifi network;
- Data portability. In some circumstances, you may have the right to request that data which you have provided to us is provided to you, so you can transfer this to another data controller.
- Restriction of processing. In some cases, you may have the right to request a restriction of the processing of your personal data, such as when you are disputing the accuracy of your data held by us.
- Right to object. You have the right to object to the processing of personal data about you which is processed on the grounds of legitimate interests (see Legal Bases below).
- Direct marketing opt out. If you have elected to receive direct marketing communications from us, you can change your mind at any time by following the opt out link in any marketing communication that is sent to you. If you have elected to receive more than one type of marketing communications from us, you may need to opt out of all of them individually. It may take a few days for us to update our records before any opt out is effective.
In addition to the other disclosures described in this section, we will also share your information:
- where we have your consent to do so (including as set out in these Terms and this section);
- as reasonably necessary in order to provide the Game Service to you (for example, by providing your personal information to suppliers we may use to fulfil the Game Service or to communicate with you);
- where it is necessary to carry out your instructions (for example, to process a payment instruction we must provide your personal information to our payment processors);
- where your data is in an anonymous and aggregated format, meaning you could not be personally identified from it;
- as we reasonably believe is permitted by law or regulation or as is necessary to comply with any legal obligation, or in order to enforce or apply our terms and conditions and/or any other agreement with you; or to protect the rights, property, or safety of King, our users, or others; and
- if there is a sale of the assets of King or corporate restructuring, or as a result of a change of control of King or one of its group companies, or in preparation of any of these events. Any third party to which King transfers of sells King's assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in these Terms and this policy.
We may also share your information with our service providers if necessary to enable them to provide services to us.
Security
King takes appropriate security and technical measures to protect your information from unauthorised access, loss and misuse. In addition, we request that our suppliers who process personal information on our behalf take a range of security measures designed to help protect your personal information and maintain an appropriate level of security. However, we cannot guarantee the absolute security of your information online and offline, as the Internet by its nature is not a secure environment and the nature of security risks is constantly evolving. As such, you should always take care when sharing your information online.
Legal Bases
In each case where we process your information, we do so lawfully in accordance with one of the legal basis set out under European data protection law. The legal bases which we rely upon are the following:
- Contractual Necessity. This covers data used by us in order to provide you with services that you have requested - and that we have agreed - to provide to you, such as our Game Service and customer support;
- Legal Obligation. This covers data used by us to comply with a legal obligation, such as to maintain records relating to tax;
- Legitimate Interests. This covers data used by us for purposes that are not harmful to your privacy and can be reasonably expected within the context of your use of our Games Services, such as analytics and research and optimisation of our Games Services; and
- Consent. Where we ask for your consent to use your data for a particular purpose, we will make this clear at the point of collection and we will also make clear how you can withdraw your consent.
In these Terms and this section we have explained how you can opt out of certain types of processing that we undertake and where any processing is based on your consent, you can withdraw that consent at any time. Nonetheless, if you play our games we will still collect some personal data about you and process it as otherwise described herein. If you do not wish us to collect any personal data about you at all, you should cease playing our games and stop using our Games Services.
Retention
We will keep your information for as long as your account is active or we consider necessary for the purposes described herein. We will also retain and use your information for as long as is required in order to comply with our legal obligations.
Location of storage
We store your information on servers that we control which are primarily based in the EEA. We may also use servers and engage providers that are located outside the EEA in order to process and store your information and to provide services to us.
International Transfer
We may transfer your information to affiliated entities or third parties to jurisdictions outside the EEA. Please note that these countries outside of the EEA may not have the same data protection laws as your own jurisdiction. We take steps to ensure that there are adequate safeguards and mechanisms in place (including the use of EU model clauses) to allow the transfer of your information across borders outside of the EEA.

For information collected under these Terms and this section, the data controller is Midasplayer (Skills) Limited.
6 Accounts. A person may open only one online Account and one mobile Account, and must be funded only by that person. We reserve the right to assess compliance with this requirement by checking for unique email addresses, real world addresses, credit card number and/or any other payment forms used to establish an Account.
If any Member is discovered to have more than one online Account and one mobile Account, we reserve the right to close the relevant Account and consolidate all or part of the funds in any additional Accounts into the original, legitimate Account. The maximum amount transferred, if any, will not exceed the total amount of deposits, less any withdrawal requests that have been paid on the additional Accounts. All winnings will be forfeited. Furthermore, we have the right to deduct the reasonable transactions costs of doing this from the amounts being transferred to the original Account.
Continued breach may, at our discretion, result in the termination of all the relevant persons Accounts and banning from the Games and the Games Service. We reserve the right to terminate all affected Accounts if we conclude, acting reasonably, that a person controls or operates more than one online Account and one mobile Account
We will not be liable to you for any loss that you may incur as a result of an unauthorised person accessing your Account and we accept no liability resulting from its unauthorised use, whether fraudulent or otherwise. As is usual, it is for you to ensure that your Account password is kept completely secret.
By opening an Account, you agree to allow us access to your Account to investigate complaints and/or other allegations of abuse.
At the termination of an Account, a sum equal to the remaining amount of funds that may be withdrawn in the Account will be returned to you once you have (a) proved your identity and (b) confirmed your email address to us, to our reasonable satisfaction. Deposits of funds made in the Account, less any withdrawals that have been made on the Account, will only be credited to a PayPal account that is registered in your name.
Where we have a serious and reasonable suspicion of fraudulent activity on an Account, we reserve the right to withhold the payment of withdrawable funds to a Member until the end of the charge-back period which applies to the payment method used to pay in the relevant funds.
If we reasonably suspect that you are accessing Royal Games via a virtual private network, remote server or similar, we may terminate your Account immediately. If we terminate your Account, any winnings in your account will be forfeited.
7 Legality. We may monitor the location from which you appear to access the Games and, may use techniques which are intended to block access from any location in which participation in the Games may be illegal or restricted as we may determine in our sole and absolute discretion from time to time. Accordingly, we may require a Member receiving any prize to provide proof that he or she is eligible to participate and if we determine in our sole and absolute discretion that you are not eligible, we may refuse to award the prize.
You must comply with the laws which apply to you in the location you access the Games from. If any laws applicable to you restrict or prohibit your participation in the Games, then you must comply with those legal restrictions.
Without limiting the foregoing, you understand and agree that this website, the Games and the Games Service may not be used, accessed, downloaded, or otherwise exported, reexported, or transferred in contravention of applicable export control, economic sanctions, and import laws and regulations, including, but not limited to, the U.S. Export Administration Regulations (“EAR”) and regulations promulgated by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”). You represent and warrant that you (1) are not subject to U.S. sanctions or export restrictions and otherwise are eligible to utilize this website, the Games and the Games Service under applicable laws and regulations; (2) are not located or ordinarily resident in a country or region subject to comprehensive or near-comprehensive U.S. sanctions/embargo, unless your use of this website, the Games and the Games Service in such country or region is authorized by U.S. law; (3) are not an official, employee, agent, or contractor of, or directly or indirectly acting or purporting to act for or on behalf of, a government (including any political subdivision, agency, or instrumentality thereof or any person directly or indirectly owned or controlled by the foregoing) or political party (e.g., Cuban Communist Party, Workers’ Party of Korea) subject to U.S. sanctions/embargo or any other entity in a sanctioned/embargoed country or region or subject to U.S. sanctions/embargo; and (4) will not use this website, the Games or the Games Service in connection with an end-use prohibited by U.S. law.

8 Operation of Games. We have the right to withdraw or modify one or more Games or aspects of the Games where we have legal or technical reasons to do so, including (a) privacy, data protection or other legal objections to the content or conduct of the Games, and (b) technical difficulties experienced by us or on the Internet. There may also be times when the Games become unavailable, whether on a scheduled or unscheduled basis. For security or other reasons, we may require you to change password or other information which facilitates access to the Games.
9 Abuse of the Games. Members may not use unfair methods to play the Games. Any technique which allows a Member to use anything other than pure skill in the conduct of a Game is unfair for these purposes. Such techniques may include, but are not limited to, multiple online or mobile Accounts (see Clause 6 above), the use of program codes or commands or any adapted hardware or software to assist play, the impersonation of another Member, or deliberately losing Games for the purpose of getting a competitive advantage. Further, Members must not do anything that may cause a disruption or malfunction of the Games.
10 Suspension and Termination for Breach. We reserve the right (a) to suspend or terminate any Member’s access to the Games, or parts of it, and (b) to forfeit from the relevant Account(s) all winnings, if the relevant Member or material appears to us to be in breach of any provision of these Terms. Forfeiture of winnings applies strictly where Clauses 6 or 9 are breached; see Clause 13 for how forfeited winnings are dealt with. Any person whose access has been suspended or terminated must not re-register for, or re-access, the Games without our prior written consent. You are responsible for everything that is done on or through your Account while you are logged in.
11 Relevance. The Games are intended to be used by Members for the purposes referred to in Clause 2 above. Accordingly, Members must not:
- use the Games for any other purpose;
- place material on, or otherwise use, the Games for any business, advertising or commercial purpose;
or use your access to the Games, or information gathered from it, for the sending of unsolicited bulk email (also known as “spam”).
12 Fees. There are standard fees for all cash Accounts as follows: Playing fee: Approximately 25% of the entry cost for a Cash or Progressive jackpot tournament represents a fee paid by you to us for hosting the Game. The remaining 75% of the entry cost is not paid to us, but goes into the player's prize fund to be paid by players to the winner(s) of the Games. See the section Money for more details.
Withdrawal Fee: Each withdrawal from your Account will incur a processing fee of up to £2 per request. If an Account balance (excluding any non-withdrawable funds) is lower than the withdrawal processing fee, the withdrawal request will not be completed.
When you credit your mobile Account with funds, the amount credited will be worth less than the amount that you paid. This is because you are charged a small transaction cost for making a deposit. The amount charged will be stated before you make payment.
We may add new or ancillary services from time to time which require the payment of fees either to us or a nominated third party on terms which will be provided to you at the time.
13 Unallocated Member Funds. From time to time, we will hold funds which are not allocated to Members. This may occur for a number of reasons including where a Member’s winnings are forfeited, or if we are unable to place funds in an Account because it has already been closed by a Member. We may use these funds for a variety of purposes including using them for “Freeroll tournaments” (these are free entry prize tournaments which are open to all Gold Players with qualifying skill rankings), donations to registered charities, developing and improving the Games and Games Service or anything else that we believe appropriate.
14 Prohibitions. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not us, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available through the Games. We do not control Content posted on our website in relation to the Games by third parties, and as such, we do not guarantee the accuracy, integrity or quality of such Content. You understand that by playing the Games Service, you may be exposed to Content that you may consider to be offensive, indecent or objectionable. Under no circumstances will we be liable in any way for any Content including, but not limited to any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available in relation to the Games.
You agree not to:
- upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- use the Games to harm minors in any way;
- use the Games to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;
- forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Games;
- remove any proprietary notices from the Games Service;
- cause, permit or authorise the modification, creation of derivative works, or translation of the Games without our prior express written permission;
- use the Games for any commercial purpose or the benefit of any third party or any manner not permitted by the licenses granted in these Terms;
- use the Games for fraudulent or abusive purposes;
- attempt to decompile, reverse engineer, disassemble or hack the Games, or to defeat or overcome any encryption technology or security measures implemented by us with respect to the Games and/or data transmitted, processed or stored by us;
- harvest or collect any information about or regarding other Members or Members’ Accounts, including, but not limited to any personal information;
- upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
- upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
- upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes”, or any other form of solicitation;
- upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Games are able to type, or otherwise act in a manner that negatively affects other users' ability to compete in Games or engage in real time exchanges;
- interfere with or disrupt the Games or servers or networks connected to the Games, or disobey any requirements, procedures, policies or regulations of networks connected to the Games;
- use the Games to intentionally or unintentionally violate any applicable local, state, national or international law, and any regulations having the force of law; and/or
- use the Games to "stalk" or otherwise harass another.
15 Alerting us. If you see anything relating to the Games which appears to infringe these Terms, then please contact us to inform us of it by using the "Report Abuse" function, or by contacting us here.
16 The Refer-a-Friend Policy. The terms of any “Refer-a-Friend Policy” that we may make available to you will be provided to you separately to these Terms.
17 Withdrawal of material. We will remove any material on the Games which we determine in our sole discretion is capable of breaching any part of these Terms or which may bring the Games into disrepute. However, each user acknowledges that we do not actively monitor material which is contributed by Members on the Games, and we make no undertaking to do so.
18 Disclaimer and Release. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAW IN NO EVENT SHALL WE BE LIABLE WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE (WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY OR STRICT LIABILITY OR OTHER THEORY), FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION ANY LOSS OF DATA, SERVICE INTERRUPTION, COMPUTER OR OTHER DEVICE FAILURE OR PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS SITE OR THE GAMES, INCLUDING ANY DAMAGES RESULTING THEREFROM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR ONLY RIGHT WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH THE GAME SERVICE IS TO TERMINATE YOUR ACCOUNT AND DISCONTINUE ANY USE OF THE GAMES AND THE GAMES SERVICE.
19 Intellectual Property. You acknowledge that all copyright, trade marks, and other intellectual property rights in and relating to the Games, other than material which is contributed by Members, are owned by us. It can be easy to copy material that appears on websites, but this does not mean it is legal. Therefore, no-one may copy, distribute, show in public or create any derivative work from the Games, or any of the material which is found on the Games, unless properly licensed to do so by (a) us and (b) where material contributed by one or more Members is concerned, by the Member(s) in question.
By submitting any material to the Games Service, you:
- are representing that you are fully entitled to do so and you;
- grant us a non-exclusive, royalty-free, non-terminable licence to copy, modify, distribute, show in public and create derivative works from that material solely in the course of its processing and display on and through the Games Service in accordance with these Terms; and
- authorise us to adapt the relevant material in the course of doing so, and so waive your moral rights to object to any derogatory treatment, or to be identified as the author, of the material in question.
We grant you a limited licence to access and use the Games subject to these Terms. However, this licence does not allow you to make any commercial use or and derivative use of the Games (including any of its individual elements or content).
20 Maximum liability. Without limiting the preceding Clause, during any period of twelve months, our aggregate liability under these Terms (whether arising in negligence, breach of contract or otherwise) will not under any circumstances exceed the greater of (a) £5, or (b) an amount equal to the sums you have paid into your Account during the relevant period of twelve months, regardless of the cause or form of action.
21 Non-excluded Liabilities. Nothing in these Terms limits our liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.
If (a) there is a technical failure of the Games which causes, as a result, a tournament to be uncompleted, and (b) it is determined by us with certainty that the responsibility for the failure lies completely within our control, then, after examining the cause of the malfunction, we will refund to your Account an amount up to the equivalent in entry costs that were charged to your Account for joining the particular tournament. We do not have any liability to pay winnings which may potentially have been won in an uncompleted tournament.
22 Indemnity. You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of these Terms by you or through any computer that you use to access the Games.
23 Assignment. We reserve the right to assign these Terms and to assign or subcontract any or all of our rights and obligations under these Terms. You may not without our written consent assign or dispose of your Account or these Terms.
24 Entire Agreement. These Terms set out the whole of the agreement between us and you concerning the Games and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us. A person who is not a party to these Terms has no right to rely upon or enforce any part of these Terms.
25 Changes to these Terms. We reserve the right to update these Terms from time to time. When we do so, we will notify you of this on the main screen of the Games, after which your continued use of the Games will constitute your acceptance of the new Terms commencing 30 days after the date of posting (or such later date as we indicate in the relevant posting). If you do not wish to be governed any new version of the Terms, you must notify us of this in writing on or before the date that the new version of the Terms will apply and from that date you must stop using the Games.
26 Severability. In the event that any part of these Terms is held to be invalid or unenforceable by judicial decree or decision, the remainder of these Terms shall remain valid and enforceable.
27 Law. These Terms shall be governed by and construed in accordance with English law.
